Terms of Service

The terms governing your use of the Somssii service.

Last updated: October 5, 2026 (Effective date of Article 5(2) and Article 5-2: October 12, 2026)

These Terms of Service set out the conditions for using Somssii (somssii.com) (the “Service”), an image variation (set generation) and Shorts video production service operated by WebGift (웹기프트) (the “Operator,” the “Company,” “we” or “us”). These Terms apply to every user of the Service (a “User”).

Article 1 (Preamble)

1.1. The Operator operates the following brand and website: Somssii (somssii.com) — a web-based service that uses AI to generate multiple images (a set) with different composition, color palette and mood from a single image uploaded by the User while preserving its subject and text, and that uses AI to plan and produce 9:16 vertical videos (Shorts and Reels) based on the request and reference URLs entered by the User.

1.2. By signing up for or using the Service, you are deemed to have agreed to these Terms. For Users who pay for a credit plan (one-time purchase), the Refund Policy additionally applies together with these Terms.

1.3. In these Terms, “Output” means all deliverables generated by the Service through analysis of the images uploaded by the User and the text and reference URLs entered in a Shorts request (collectively, “Input”), including image sets (each variation image, ZIP bundles and concept information) and vertical videos (video files and posters).

Article 2 (Right of Use)

2.1. Output generated with free credits (credits granted upon sign-up, free previews and samples) may be used only for personal, non-commercial purposes and for the purpose of evaluating the Service. Output generated with paid credits may be used freely, including for direct and indirect commercial purposes.

2.2. The Operator has the right, without stating reasons, to restrict use of the Service or block a User in order to ensure the stable operation of the Service and to protect other Users.

2.3. The User consents to the Operator storing the User's IP address in order to check for excessive use of the Service.

2.4. Children under the age of 14 may not sign up for or use the Service. In these Terms, a “child” means a person under the age of 14 (or under the minimum age at which a person may independently consent to the processing of personal information under the laws of the relevant country).

Article 3 (Rights and Obligations of Users)

3.1. The User shall not engage in any act that endangers the functionality or operation of the Service. In particular, scanning or testing the software for vulnerabilities, circumventing security systems, gaining unauthorized access to the Service's systems, and inserting malicious code are prohibited.

3.2. The User warrants that the User holds all necessary rights (including copyright, neighboring rights, industrial property rights, trademark rights and portrait rights) to the images the User uploads, or has obtained lawful permission to use them. Generating and commercially using another party's product detail pages, designs or photos without the right holder's permission is the sole responsibility of the User.

3.3. The User may not share one account among multiple people, or transfer or lend it to others, and the User is responsible for managing the User's account information.

Article 4 (Acceptable Use)

4.1. The User shall not, directly or indirectly, upload content, create Output or use the Service in any way that:

  • promotes or creates a risk of physical or mental harm, emotional distress, death or disability to oneself, others or animals;
  • promotes or creates a risk of damage to or loss of property;
  • seeks to harm or exploit children;
  • constitutes harassment, abuse, racial or ethnic disparagement, defamation, invasion of privacy or portrait rights, or threats;
  • discriminates, or incites or promotes discrimination, on the basis of race, religion, gender, sexual orientation, age, disability, origin, nationality or the like;
  • is nude, sexually explicit or obscene, or links to such material;
  • relates to the sale or promotion of illegal activities, products or services;
  • is fraudulent or promotes fraudulent activity;
  • infringes the rights of individuals or third parties, including intellectual property rights and privacy rights;
  • contains information or content that the User has no right to provide under law or under confidentiality, contractual or fiduciary obligations;
  • is false, deceptive or misleading, or promotes the spread of disinformation;
  • violates applicable laws or promotes illegal activities; or
  • threatens or undermines democratic processes or institutions.

The Operator reserves the right to determine, in its sole discretion, whether content violates this Article, and this Article may be updated from time to time.

Article 5 (Restrictions on Use)

5.1. The User shall not use the Service in a manner contrary to its intended purpose.

5.2. The User shall not, directly or through a third party: (i) rent, sell, distribute or resell the Service, provide it on a service bureau basis, or sublicense it (except where done by a Reseller approved under Article 5-2 within the scope of such approval, and to the extent permitted by these Terms); (ii) copy, decompile or reverse engineer the Service or any part thereof, attempt to extract its source code, or modify it or create derivative works from it; (iii) access the Service for the purpose of performance benchmarking; (iv) access the Service in order to build or market a competing product; (v) use the Service to store or transmit viruses or malicious code; (vi) perform data mining, extraction or scraping on the Service and its content for any purpose, including machine learning; or (vii) circumvent any measures the Operator puts in place to prevent or restrict access, including features that limit use or copying.

5.3. When using the API, the User is responsible for managing any issued API keys, and the User bears the credit deductions and liability for any use resulting from a leaked key.

Article 5-2 (Reseller Program)

5-2.1. The Operator permits businesses that have completed the procedure set by the Operator (applying to join on the reseller site reseller.somssii.com and obtaining the Operator's approval) (“Resellers”) to engage in the following activities:

  • Credit resale: transferring credits purchased from the Operator to User accounts and selling them;
  • Referral: attracting Users through a referral link issued by the Operator and receiving a commission set by the Operator;
  • White label: providing the Service under the Reseller's trade name and brand through the API and reseller store provided by the Operator; and
  • Web hosting resale: selling hosting accounts provided by the Operator to the Reseller's customers.

5-2.2. Credits transferred by a Reseller to a User account are treated in the same way as paid credits, and Output generated with such credits may be used commercially in accordance with Article 2.1.

5-2.3. Refunds of credits received through a Reseller are governed by the terms of the transaction with that Reseller, and the User may not claim a refund directly from the Operator. However, this does not limit any rights of the User guaranteed by mandatory provisions of applicable law.

5-2.4. The rights and obligations of Resellers, settlement, commissions, revocation of approval and related matters are governed by the Reseller Terms of Service posted on the reseller site.

5-2.5. If a Reseller goes beyond the scope of its approval or violates these Terms or the Reseller Terms of Service, the Operator may revoke its approval.

Article 6 (Content Review, Generated Results and Appeals)

6.1. Responsibility for content uploaded to the Service lies with the User who submitted it. The Operator does not warrant that it will review all User content before or after upload.

6.2. The Operator may review User content using automated tools and personnel, and will investigate content reported as violating these Terms or as potentially unlawful.

6.3. Anyone may report content on the Service. The reporting procedure is described in Article 11.

6.4. If the User disagrees with a review decision by the Operator, the User may file an appeal by email (seossine@gmail.com). Appeals must be submitted within 6 months from the date of the decision.

6.5. Upon receiving an appeal, the Operator will review it in a timely, non-discriminatory, diligent and non-arbitrary manner, reverse its decision if the initial judgment is found to have been wrong, and promptly notify the User of the outcome and available remedies. The Operator reserves the right to remove content from the Service at any time, for any reason, at its discretion — in particular defective files, low-quality content, content that violates these Terms, and content raising legal concerns.

6.6. As part of the Service, the Operator may provide content of the Operator or third parties (including sample images, templates and AI-generated content). Some of the sample original images in the Service's gallery are captures of external materials used as references and are provided solely for layout and markup reference purposes. The User may not sell or distribute such images on a Standalone basis.

6.7. “Standalone” means in substantially the same form as found in the Service, without any added creative effort. Merely applying filters, changing colors, resizing or cropping constitutes Standalone use, whereas combining the content with other images, text, illustrations or editing techniques to create a new creative work does not constitute Standalone use.

6.8. Generated Output is produced by artificial intelligence and automated pipelines. The User is responsible for the Input and the Output generated from it, and shall not attempt to circumvent safeguards or content protection features put in place by the Operator. The User shall not use the Service or Output to:

  • mislead others into believing that AI-generated content was created by a human;
  • create deepfakes or deceive by impersonating others;
  • remove, alter or disable source attributions or metadata of Output;
  • create or use Output in a manner that violates applicable laws;
  • create deceptive or misleading political or election content;
  • create sexually explicit content or nudity, or content that sexualizes or exploits minors;
  • create or disseminate information that infringes or restricts the fundamental rights and freedoms of others; or
  • otherwise create harmful content that violates these Terms.

6.9. The User is responsible for the Input uploaded to the Service, such as images and URLs, and for the Output generated from it, such as images. The User represents and warrants that the User holds all rights, licenses and permissions necessary to use the Input with the Service. As between the User and the Operator, and to the extent permitted by law:

  • The Operator claims no rights in the User's Input.
  • The Output belongs to the User. However, owning the Output does not mean that every part of it may be used for every purpose (e.g., commercial use). The Output may include third-party content that the Operator cannot license (e.g., another party's photos, logos or fonts included in the Input).
  • The User is responsible for ensuring that the use of the Input, the Output and the content contained in them complies with the relevant rights and licenses.
  • The User grants the Operator a royalty-free right to display, host, reproduce, store and use the Input and Output to the extent necessary for the Operator to provide the Service.
  • When using the Output, the User must comply with these Terms, and the User bears the risks arising from such use.
  • The Operator may limit the quantity of Output the User can generate, based on credits or other criteria.

6.10. Certain content (including samples, templates and AI-generated content) may be subject to additional intellectual property rights (copyright, trademark rights, design rights), moral rights, portrait rights, privacy rights and the like. Examples include identifiable people, logos, brands, products, buildings and fonts. The User is solely responsible for determining whether the consent or a license of a third party is required before using content, and the Operator does not warrant that any consent or license has been obtained and expressly disclaims any liability in that regard.

6.11. AI and automated generation can produce errors. The Operator does not verify the accuracy of Output (including text reproduction, subject preservation, color and composition), and Output does not represent the views of the Operator. The User is responsible for evaluating the accuracy and suitability of Output for the User's intended purpose. The Operator makes no warranty as to the accuracy, completeness or reliability of Output and assumes no liability whatsoever arising from the use of Output or from any omissions or errors contained in it. We recommend obtaining professional review before using Output commercially or publishing Output containing legal, medical or financial information.

Article 7 (Warranties and Liability)

7.1. Any and all warranties regarding the Output of the Service and the availability of the Service are excluded. If a warranty claim is nonetheless recognized, the warranty period shall be 6 months.

7.2. The Operator is not liable for the processing speed or availability of the Service and software, for data loss, or for the accuracy of results. Furthermore, the Operator's liability is excluded unless the damage was caused by the Operator's willful misconduct or gross negligence. This does not apply to damage to life or body.

7.3. In no event shall the Operator's liability exceed the amount actually paid by the User for the Service during the 12 months immediately preceding the occurrence of the damage, or ₩100,000 if no amount was paid.

7.4. The Service and all content provided through the Service are provided “AS IS.” The Operator makes no warranties of any kind, express or implied, including implied warranties of merchantability or fitness for a particular purpose, with respect to content (including third-party content and links), the Service, the speed of the Service, software, availability, the accuracy of information, or the rights and licenses under these Terms. The Operator does not represent or warrant that the Service or content will meet the User's requirements or that their use will be uninterrupted or error-free. The Operator shall not be liable to the User or any third party for any general, punitive, special, indirect, consequential or incidental damages, lost profits, or any other damages, costs or losses arising from the use of the Service, guidance or content.

7.5. Notwithstanding the foregoing, the rights of Users guaranteed by mandatory provisions of applicable laws (such as the Framework Act on Consumers and the Act on the Consumer Protection in Electronic Commerce, etc.) are not limited.

Article 8 (Indemnification)

8.1. To the extent permitted by law, the User shall defend, indemnify and hold harmless the Operator and its affiliates, officers, employees, agents and licensors from and against any and all claims, costs, damages, losses, liabilities and expenses (including reasonable attorneys' fees) arising out of or relating to (i) the User's breach of these Terms or (ii) the User's use of the Service.

Article 9 (Confidentiality and Privacy)

9.1. All information regarding the processing of personal information in the Service can be found in the Privacy Policy. Information on the use of cookies is available in the Cookie Policy.

9.2. Images uploaded by the User and Output are processed solely for the purpose of providing the Service and are not made public unless the User creates a share link or consents to publication in the gallery.

Article 10 (Term and Termination)

10.1. These Terms take effect when the User first accesses the Service and remain in effect until the account is deleted or terminated.

10.2. If the Operator determines, in its reasonable discretion, that the User or the User's use of the Service violates these Terms, the Operator may take one or more of the following measures: (i) removal of prohibited User content; (ii) suspension of use of the Service; (iii) termination or deletion of the account; (iv) permanent blocking from use of the Service; and (v) notification of prohibited content or activities to the relevant authorities. Upon termination, the User's right to use the Service is extinguished immediately. A User excluded from the Service by the Operator may not access the Service again.

10.3. The User may delete the account at any time by withdrawing in the account settings or by sending a request to seossine@gmail.com. Upon withdrawal, any remaining credits are handled in accordance with the Refund Policy.

Article 11 (Reporting and Appeals Procedure)

11.1. The Operator maintains a single point of contact for reporting illegal or infringing content. Please send an email to seossine@gmail.com with “Illegal content report” in the subject line.

11.2. Please include the following information in your report:

  • the reasons why you believe the content is illegal or infringes rights (which laws or rights it violates);
  • the URL of the content and, where necessary, additional information that helps identify the content;
  • the name and email address of the reporter (optional); and
  • a statement that you believe the information in the report is accurate and complete.

11.3. If you believe the Operator has taken an incorrect action regarding your account or content, you may file an appeal at seossine@gmail.com within 180 days of the date of the action. Copyright infringement reports and appeals against them are handled in accordance with the procedures set forth in the Copyright Act.

11.4. Requests from investigative and administrative agencies are received through the above point of contact and handled in accordance with the requirements and procedures set forth in applicable laws.

Article 12 (Payment and Credits)

12.1. Use of the Service is deducted in credits (1 credit = ₩100; 100 credits = ₩10,000). For set generation, 10 credits are deducted per set (10 images by default) at the time of submission, regardless of image size, aspect ratio or concept pack, and credits for the number of images that could not be made due to an engine error are automatically refunded on a pro-rata basis upon completion. Remaking one image of a set with the same concept costs 1 credit. Free credits are granted upon sign-up, and the price per credit and the credits per set follow the values posted on the Pricing page.

12.2. Credits are one-time purchase products and do not renew automatically. Purchased credits can be used with no expiration date, and each purchase is added to the existing credits.

12.3. Prices and the credit policy are posted on the Pricing page, and any changes will be announced in advance. Changed prices apply to payments made after the announcement.

12.4. Refunds are governed by the Refund Policy.

Article 13 (Final Provisions)

13.1. The laws of the Republic of Korea govern these Terms and any legal disputes arising from the use of the Service.

13.2. The competent court for disputes arising in connection with these Terms or the Service shall be the court having jurisdiction under the Civil Procedure Act, and for disputes with Users who are not consumers, the Seoul Central District Court shall have exclusive jurisdiction.

13.3. The Operator may amend these Terms (and the policies and agreements referenced in these Terms) at any time. The Operator will post the latest Terms on the Service, and will give notice of any change that materially disadvantages the User's rights or use of the Service through an in-service notice or the account email 7 days before the effective date (30 days before for changes unfavorable to Users). If the User continues to use the Service after the amended Terms take effect, the User is deemed to have agreed to the amended Terms.

13.4. Even if any individual provision of these Terms is invalid, unenforceable or unlawful, the Terms as a whole shall not be invalidated. In such case, the parties agree to replace the provision with a provision that most closely achieves its economic purpose.

13.5. Translations of these Terms into languages other than Korean are provided for convenience only, and in the event of any discrepancy in interpretation, the Korean version shall prevail.

Addendum

These Terms (as amended in Article 5(2)(i) and with the newly added Article 5-2) take effect on October 12, 2026.
